Terms of service

This store (trynightward.com) is operated by Roseva Group LLC, a limited liability company organized under the laws of the State of Wyoming, United States, registered with the Wyoming Secretary of State under number 2026-001980624, with its registered office at 30 N Gould St Ste N, Sheridan, WY 82801, USA ("we", "us", "our"). By using this site or placing an order, you agree to these terms, our Shipping Policy, our Refund Policy and our Privacy Policy. Section 14 contains an agreement to resolve disputes through individual arbitration and a waiver of class actions — please read it.

1. Orders

Adding a product to your cart is not a contract. A contract is formed when we accept your order and send you an order confirmation. We may decline an order — for example if a product is out of stock, if the price was displayed incorrectly, or if we suspect fraud. If we decline after you have paid, you get a full refund. Products are sold for your own personal use, not for resale.

2. Prices and payment

All prices are in U.S. dollars. Applicable sales tax is calculated and shown at checkout and added to the total. Prices, discounts and promotions can change; the price that applies is the one in effect when you place your order and shown in your order confirmation. Free gifts included with certain bundles are available while supplies last, have no cash value and may be replaced with an item of equal or greater value. We accept the payment methods displayed at checkout. Payment is captured when the order is placed.

3. Products

We describe our products as accurately as we can. Screens vary, so colors and packaging may differ slightly from the photos. Specifications and design can change as we improve our products; the instructions that come with the product you receive apply.

4. About carbon monoxide and gas detection

  • Nightward is a plug-in detector for carbon monoxide and combustible gases. It is one part of home and vehicle safety — it is not a substitute for maintaining your appliances, furnace, water heater, generator or propane system, and not a substitute for professional inspection. Have fuel-burning appliances serviced regularly by a qualified technician.
  • Install, test and use the unit as described in the instructions in the box. The unit monitors the air only while it is plugged in and has power.
  • If the alarm sounds or the display shows rising gas levels, get everyone out into fresh air right away and call 911 or your gas provider.
  • No detector can guarantee against injury, illness or property loss.

5. Shipping, returns and refunds

See our Shipping Policy and our Refund Policy, including our 60-Day Money-Back Guarantee. Those policies form part of these terms.

You are responsible for entering a correct and complete shipping address. Title to the products and the risk of loss pass to you when the carrier's tracking confirms delivery to the shipping address entered at checkout.

6. Accounts

If you create an account, you are responsible for keeping your login details confidential and for activity under your account. Tell us if you believe your account has been used without your permission.

7. Your content

If you send us reviews, photos or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce and display it in connection with our business. You confirm the content is yours to share, reflects your honest experience, and does not infringe anyone's rights.

8. Our content

Everything on this site — text, photographs, graphics, logos, product imagery and layout — belongs to Roseva Group LLC or its licensors and is protected by copyright and trademark law. You may not copy, reproduce or use it commercially without our written permission.

9. Disclaimer

Except as expressly stated in these terms and in our Refund Policy, the site and our products are provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. Some states do not allow certain warranty disclaimers, so parts of this section may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to your order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential damages. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

11. Payment disputes

If something is wrong with your order, please contact us at support@trynightward.com before opening a dispute or chargeback with your bank or card issuer — we can usually resolve it faster directly. If a dispute is opened, we may share our records of your order with the payment provider, including the order and payment details, the information collected at checkout, shipping and delivery tracking, and our correspondence with you. We will contest disputes for orders that were delivered as described and not returned under our Refund Policy. If you receive a refund from us and also through a dispute for the same order, we may recover the duplicate amount. We may decline future orders from customers who file disputes that are not justified.

12. Electronic communications

By placing an order, you agree to receive order confirmations, shipping updates and other service messages by email. Emails between you and support@trynightward.com count as written communication and are kept as a record of your order.

13. Governing law

These terms and any dispute between you and us are governed by the laws of the State of Wyoming, United States, without regard to conflict of law rules, and by the Federal Arbitration Act for Section 14. Nothing here affects consumer protection rights you may have under the law of your own state that cannot be waived by agreement.

14. Dispute resolution — individual arbitration and class action waiver

Talk to us first. Before starting any formal proceeding, you agree to email a written description of your concern, your order number and the outcome you'd like to support@trynightward.com and to give us 30 days to resolve it. Most concerns are resolved within a few days.

Binding individual arbitration. If we can't resolve a dispute informally, any dispute, claim or controversy arising out of or relating to these terms, our site, our products or your purchase will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, instead of in court. The arbitration may be conducted by video, by phone or on written submissions, or in person in the county where you live. Fees are paid as set out in the AAA Consumer Arbitration Rules. Either of us may instead bring an individual claim in small claims court if it qualifies.

Class action and jury trial waiver. You and we may bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not combine claims of more than one person. You and we each waive the right to a trial by jury.

Opting out. You can opt out of this arbitration agreement by emailing support@trynightward.com within 30 days of your first order, with your order number and a statement that you opt out of arbitration. Opting out does not affect any other part of these terms.

Courts. If the class action waiver is found unenforceable for a claim, this arbitration agreement does not apply to that claim. Any claim not subject to arbitration will be brought only in the state or federal courts located in Sheridan County, Wyoming, to the extent permitted by law, and you and we consent to their jurisdiction.

15. General

If any part of these terms is found invalid or unenforceable, the rest remains in effect. Our failure to enforce any part of these terms is not a waiver. These terms, together with the policies linked above, are the entire agreement between you and us about your use of this site and your purchase.

16. Changes

We may update these terms. The version in force is the one published on this page at the time you place your order.
